Allowability is the cornerstone of cost-reimbursement contracting. FAR Part 31 establishes criteria (reasonableness, allocability, compliance with CAS and contract terms) to determine which costs incurred by the contractor the Government is obligated to reimburse. It does not cap profit (that’s the fee), establish a fixed ceiling (that’s the contract’s total estimated cost/funding limit), or mandate uniform indirect rates (rates are negotiated).

While the contracting officer administers the contract terms, physical and personnel security requirements for facility access are almost always controlled by the agency’s security officials, not the contract clauses themselves. The CO’s role is to ensure the contractor complies with the security requirements stipulated in the contract (like providing information for badges). Termination for convenience is not an appropriate tool to remedy a contractor’s bidding error.

This is a core procurement concept. The technical evaluation (or past performance/management evaluation) judges the merits of the proposal itself—its approach, features, and benefits relative to the solicitation’s criteria. The responsibility determination (FAR 9.1) is a separate assessment of the offeror’s overall capability and reliability as a business entity (financial resources, record integrity, capacity, etc.) to perform any contract successfully. They are distinct but both necessary for award.

For commercial items, the preferred method of price analysis is comparing proposed prices to prices for the same or similar items sold in the commercial marketplace under comparable terms (FAR 15.404-1(b)(2)). Catalog prices can be a starting point but may not reflect actual market pricing or discounts. Simply accepting a catalog price without verification is not sufficient diligence. Cost analysis is not the preferred method for commercial items. Using prices from different suppliers for different items is not a valid comparison for the same commercial item.
